  • In this presentation Margaret Austin and Siobhan Kenny of the construction department of Eugene F Collins will consider some of the more common amendments to the standard RIAI contract. The aim of the briefing is to: assess the reasons for the changes; why they are proposed; and to look at the contractual implications of the changes – which contracting parties need to review when risk assessing and pricing a proposed contract.

    Practitioners will be familiar with the almost universal deletion of the wage and price variation clause. There are other common changes to the standard clauses and this briefing will consider the reasons behind many of these changes and why parties and their advisors seek their inclusion.

    More often than not an amended RIAI Contract will also include a range of additional clauses many of which are included to meet the specific requirements of an individual project, some are site specific, some are specific to the type of project e.g. large residential developments or fit out projects, or amended to deal with funder or purchaser requirements on matters such as collateral warranties, insurances and bond requirements, and others to address issues of concern such as Brexit and COVID 19 and issues of concern to the developer perhaps informed by previous experience. We will review many of these to give an understanding of the rationale for the additions from the differing perspectives of the typical parties engaged on a construction project.
