One of the most important factors in your construction contract is knowing when and how to make a claim for time and/or money. Doing so successfully allows for commercial recovery to be maximised and for risk to be reduced.
This starts with understanding how construction contracts deal with money and delay claims and the common pitfalls associated with unsuccessful claims.
This one-hour seminar will focus on making a claim from the perspective of a contractor and Dermot will discuss the primary forms of construction contracts used in Ireland, concentrating on topics such as:
- PWC and RIAI contracts;
- Risk allocation;
- Notification requirements;
- The Burden of Proof
- Time claims; and
- Money claims;
An Associate Director of Quigg Golden, Dermot Durack is a practicing adjudicator and is a member of the Construction Contracts Adjudication Panel in Ireland and is frequently appointed to decide disputes between parties. Dermot is also a chartered quantity surveyor who has worked on both the contractor and client sides, and so will be able to discuss contractor’s claims from both perspectives.
Whilst this seminar will focus on making claims from a contractor’s perspective, it will provide useful awareness to employing parties on the allocation of risk in construction contracts and the quantum and entitlement burden required to be fulfilled by contractors when making a contractual claim.
Speaker
Dermot is an Associate Director at Quigg Golden where he provides advice and support on both contentious and non-contentious construction and procurement matters. His specialties include dispute resolution such as adjudication and conciliation and he also advises on contract drafting and procurement.
Dermot is a Chartered Quantity Surveyor and Barrister at Law (non-practicing) with over 30 years Construction Experience. During his career, Dermot has worked for Clients, Contractors and Sub-contractors and has extensive experience of Quantity Surveying, Procurement, Contract Administration and Project Management on large complex projects including pharmaceutical, data centers, power plants, medical and food projects.
With this breadth of experience across many sectors and various roles, he can assess and understand the issues from multiple perspectives while putting his industry knowledge to use advising our clients quickly and efficiently.
Dermot is also active in the industry volunteering with the Chartered Institute of Arbitrators and the Society of Chartered Surveyors and sits on a number of Panels as a Dispute Resolver including the Irish Ministerial Panel of Adjudicators.
