Join us on the 26th June for a CPD on ‘A licence or a lease? Since the RTB was established 20 years ago the question, is it a licence or a lease has been in front of an RTB Adjudicator or their Tribunal Board. The outcomes have been different because the relationships and structure of each circumstance have had either major differences or even subtle ones that affect the final RTB Determination Order. This CPD will clearly set out the many characteristics of a licence agreement relationship that must be in place for it to be deemed a licence that the RTB does not have jurisdiction over as opposed to a traditional lease agreement (fixed or other) and hence a tenancy that is covered by the Residential Tenancies Act 2004.

Marcus has over 25 years’ experience in the property industry. He worked in 2 of the big 5 auctioneers for many years before setting up his own general property services provider agency, MFO The Property Professionals in 2008. Its core competencies are Residential & Commercial Valuations, Lettings, Management & Sales. Marcus is also heavily involved with RTB dispute resolution. Marcus is a Fellow of the SCSI & RICS. Marcus is hugely involved with the SCSI and has been for 20 years giving CPDs and was President of the YSCSI for 2 years. Currently Marcus is on the SCSI National Council, Chairperson of the Practice & Policy Committee, Vice-Chair of the Residential Professional Group, the residential representative on the Sustainability Committee and contributes to the Irish Times Property Clinic on a regular occasion. Finally, Marcus was Chairperson of the National Auctioneering and Property Services Apprenticeship Committee for 5 years and these Apprenticeship courses were formally launched on 11th April 2019 by Joe McHugh TD, Minister for Education and Skills and are now available to attend all over the country.
