Governance of the Registration Body
Building Control Act 2007 (The Act) – Parts 4 & 5 Registration of titles of certain Building Professions
The Act provides that the use of titles of ‘‘Quantity Surveyor’’ and ‘‘Building Surveyor’’ will be confined to persons with recognised qualifications and experience, whose names are entered on a statutory register. The relevant registers are administered by Society of Chartered Surveyors Ireland.
The Act designates the Society of Chartered Surveyors Ireland as the Registration Body and as the competent authority in the State under the EU Directive 2005/36/EC.
Registration of Quantity Surveyors and Building Surveyors
Parts 4 and 5 of the Act specifies the statutory protection of the title of ‘‘Quantity Surveyor’’ and “Building Surveyor” by limiting the lawful use of this title to suitably qualified persons whose names are entered on a statutory register. The Act also specifies the criteria for eligibility for admission to the relevant register.
Statutory Boards & The Registrar
The Act provides for statutory Admissions Boards, Technical Assessment Boards, and Professional Conduct Committees. The Act further provides for Appeal Boards to determine appeals against decisions of any of the aforementioned Boards, with an ultimate right of appeal against decisions of the Appeal Boards to the High Court.
The Act provides for payment of registration fees and appointment of a Registrar and for the determination of fines or penalties for misuse of the title of
‘‘Quantity Surveyor’’ and “Building Surveyor”.

Admissions Board
The purpose of the Admissions Board is to consider applications for registration under section 29 and 43 of the Act and recommend applicants for registration to the statutory registers of building or quantity surveyor. Membership of the Admissions Board is comprised of a Chair and 7 members as follows:
(i) 3 surveyors are nominated by the registration body, following consultation with the Chartered Institute of Building (CIOB), Association of Building Engineers (ABE) and Institution of Civil Engineering Surveyors (ICES)
(ii) 4 persons (who are not surveyors) are nominated by the Minister
(iii) the chair, who is appointed by the Minister, is a solicitor, barrister or a former judge of the Circuit Court, High Court or Supreme Court.
Technical Assessment Board
The purpose of the Technical Assessment Board is to consider applications for registration from persons who are not eligible for registration under sections 29 or 43. Membership of the Technical Assessment Board is comprised of a Chair and 7 members as follows:
(i) 3 surveyors are nominated by the registration body, following consultation with the Chartered Institute of Building (CIOB), Association of Building Engineers (ABE) and Institution of Civil Engineering Surveyors (ICES)
(ii) 4 persons (who are not surveyors) are nominated by the Minister
(iii) the chair, who is appointed by the Minister, is a solicitor, barrister or a former judge of the Circuit Court, High Court or Supreme Court.
Professional Conduct Committee
The Professional Conduct Committee examine complaints made in regard to alleged professional misconduct and poor professional performance. The Professional Conduct Committee is comprised of a Chair and 11 members as follows:
(i) 5 surveyors are nominated by the registration body, following consultation with the Chartered Institute of Building (CIOB), Association of Building Engineers (ABE) and Institution of Civil Engineering Surveyors (ICES)
(ii) 6 persons (who are not surveyors) are nominated by the Minister, 1 of whom will be nominated by the Minister with the consent of the Minister for Enterprise, Trade and Employment
(iii) the chair, who is appointed by the Minister, with the consent of the Minister for Enterprise, Trade and Employment, is a solicitor, barrister or a former judge of the Circuit Court, High Court or Supreme Court.
Appeals Board
The Appeals Board is comprised of a Chair and 5 members as follows:
(i) 2 surveyors, are nominated by the registration body following consultation with the Chartered Institute of Building (CIOB), Association of Building Engineers, neither of whom are a member of any Board or Committee established under the act
(ii) 3 persons (who are not surveyors), are nominated by the Minister, 1 of whom is nominated by the Minister with the consent of the Minister for Enterprise, Trade and Employment, none of whom are a member of any Board or Committee established under the act
(iii) the chair, who is appointed by the Minister, is a solicitor, barrister or a former judge of the Circuit Court, High Court or Supreme Court.
